These Terms of Service (“Terms”) govern your access to and use of the website operated by LEMOSOMC Recovery Partners (“LEMOSOMC,” “Company,” “we,” “us,” or “our”), including LMSRecoveryPartners.com, online forms, communications, educational materials, asset-search tools, and related website services (collectively, the “Website”).
By accessing or using the Website, submitting information through the Website, or requesting information from LEMOSOMC, you acknowledge that you have read and agree to these Terms. If you do not agree, please discontinue use of the Website.

LEMOSOMC Recovery Partners assists individuals, estates, heirs, businesses, and other potentially entitled parties with identifying, researching, documenting, and pursuing certain recoverable assets.
Depending upon the circumstances and applicable law, our services may involve foreclosure surplus funds, tax-sale or tax-deed surplus proceeds, unclaimed property, estate or inheritance-related assets, insurance-related proceeds, and other legally recoverable funds or property interests.
Services may include preliminary asset research, ownership verification, document assistance, administrative claim support, communications with authorized fund holders, claim monitoring, and coordination with independent licensed attorneys when legal services are necessary.
Availability and scope of services vary by jurisdiction and individual case.
2. WEBSITE INFORMATION IS NOT LEGAL ADVICE

3. NO GUARANTEE OF RECOVERY
Identification of potential funds does not establish final legal entitlement.
LEMOSOMC does not guarantee that:
You are legally entitled to identified funds;
A claim will be approved;
A particular amount will be recovered;
Funds will be released within a particular period;
A court, agency, trustee, clerk, financial institution, or other fund holder will accept particular documentation; or
A recovery will occur without additional legal or administrative proceedings.
Recovery depends upon the facts of the case, applicable law, ownership interests, liens, judgments, competing claims, probate matters, bankruptcy proceedings, documentation, governmental requirements, and decisions made by third parties beyond our control.
4. PRELIMINARY ASSET INFORMATION
Information concerning potential funds may originate from court records, property records, government databases, public filings, third-party data sources, or other lawfully available information.
Although we strive for accuracy, public and third-party records may contain errors, omissions, outdated information, or processing delays.
Any amount presented before final verification should be considered preliminary.
5. FORMATION OF A CLIENT RELATIONSHIP
Visiting this Website, completing a “Check for Assets” form, requesting a consultation, speaking with a Recovery Advocate, or receiving information from LEMOSOMC does not by itself create a contractual recovery relationship.
A client relationship for recovery services is established only after the required agreement or authorization has been properly executed and accepted, where applicable.
The signed agreement governing a particular recovery controls the parties' respective rights and obligations for that matter.
If these Website Terms conflict with a subsequently executed Asset Recovery Agreement concerning the same services, the executed Asset Recovery Agreement controls with respect to that recovery.
6. FEES AND COMPENSATION
Fees for recovery services are disclosed in the applicable written agreement before services subject to those fees begin.
Fees may vary according to the type of asset, jurisdiction, complexity of the matter, and applicable law.
Certain jurisdictions regulate, restrict, or cap fees associated with surplus or unclaimed-property recovery. LEMOSOMC intends to structure compensation in accordance with applicable requirements.
Nothing displayed on this Website supersedes a legally applicable fee limitation.
7. NO UPFRONT RECOVERY FEE REPRESENTATION
Where LEMOSOMC offers services on a contingency basis, compensation is generally dependent upon a successful recovery as specified in the applicable written agreement.
Additional expenses, legal fees, filing fees, probate expenses, court costs, or other third-party charges may arise in certain matters. Any responsibility for such expenses will be governed by the applicable agreement and law.
8. CLIENT RESPONSIBILITIES
When requesting or receiving services, you agree to provide accurate, current, and complete information.
You must disclose information reasonably relevant to your claim, including known co-owners, heirs, estates, trusts, liens, judgments, bankruptcies, competing claims, previous assignments, and agreements with other recovery companies or attorneys.
You agree not to knowingly submit fraudulent, altered, misleading, or unauthorized documentation.
LEMOSOMC may suspend or discontinue assistance when information cannot be verified, fraud is suspected, required documentation is not provided, or continuing the matter would violate applicable law or professional standards.
9. IDENTITY AND OWNERSHIP VERIFICATION
Protecting rightful owners is fundamental to our recovery process.
We may request documentation necessary to verify identity, ownership, heirship, authority, or entitlement.
Depending upon the claim, this may include identification, proof of address, deeds, probate records, death certificates, marriage records, corporate records, trust documents, affidavits, court records, or other supporting documentation.
We reserve the right to decline to process a claim when identity or entitlement cannot reasonably be verified.
10. NATIONWIDE ATTORNEY NETWORK
Certain recovery matters may require legal review, probate proceedings, court filings, representation, or other services that may only lawfully be performed by a licensed attorney.
LEMOSOMC may coordinate with independent licensed attorneys where appropriate.
Attorneys participating in our network remain responsible for their own professional judgment, ethical obligations, licensing requirements, and attorney-client relationships.
References to our nationwide attorney network do not mean that an attorney is automatically assigned to every matter or that LEMOSOMC itself provides legal services.
11. AUTHORIZATION AND POWER OF ATTORNEY
Certain claims may require an authorization, limited power of attorney, agency-specific form, or other instrument permitting communications or actions on behalf of a claimant.
The authority granted by any such instrument is governed by the instrument itself and applicable law.
Nothing in these Website Terms independently grants LEMOSOMC authority to transfer ownership of your claim, negotiate checks payable to you, control your bank accounts, or exercise powers beyond those expressly and lawfully authorized.
12. ELECTRONIC COMMUNICATIONS

Consent to receive marketing text messages is not a condition of purchasing services.
Your carrier is not responsible for delayed or undelivered messages.

Before commencing formal litigation concerning these Website Terms, the parties are encouraged to make a good-faith effort to resolve the dispute informally.
Nothing in these Terms prevents either party from seeking relief where immediate judicial intervention is necessary or where applicable law provides rights that cannot be waived.
Any mandatory arbitration, venue selection, class-action waiver, or similar provision applicable to a specific client engagement should appear in the signed client agreement, rather than being imposed solely through general Website Terms.

We may revise these Terms to reflect changes in our Services, technology, business practices, or applicable law.
The current version will be posted on our Website with an updated “Last Updated” date.
Changes apply prospectively unless applicable law requires otherwise.
25. SEVERABILITY AND NO WAIVER

Failure by LEMOSOMC to enforce a provision on one occasion does not constitute a permanent waiver of that provision.
